I was sitting in a chair beside the dying man, in a dimly lit room. Staff were kind to me and even gave me a heated blanket – though I did not have conversation with them or discuss the care øf the dying man. At 2:00 AM I became aware of two large uniformed persons standing in the darkened doorway, who asked me to step into the hallway. The male constable demanded my license. He then read me my rights, cautioned me, told me to call a lawyer if I wished and said anything I said could be used against me. I was frightened (AND VERY TIRED) and said I did not wish to cause a problem but that I had been there that day/afternoon and often before, The male constable, who was the only one who addressed me, said that I should stop saying that because he would have to give me additional tickets for that. He filled out the attached. He informed me that there was a restraining Order against me signed by a judge in the Misericordia Security office. I have never been served any documents, Restraining Order in this regard or was aware of what he was claiming. I had been removed from the Misericordia Hospital on February 19, 2004 – note “Case Study” in www.elderadvocates.ca . They walked me past the nursing station, out of the nursing home, to my car. Maureen Simpson YOU have to contact the media. Call your newspaper or TV station or both. These days it seems it's the only way to get things done. Set up a family spokesperson who can deal with the media interviews on your behalf. It doesn't have to be a family member. A lawyer would be a good choice... along with a family member.

Mom is still at hospital in emergency everyone . Had meeting today at hospital and hoping she can stay there until an answer comes back on the other care home to get her in . If not we will have to get her set up in a apartment . No media has contacted us yet. So let's keep sharing how this care home abused my mom

Julie AliThe health advocates are pretty unproductive. They told our family when my sister was evicted and I was banned that there was nothing they could do for us. This is the truth. The government of Alberta has arranged the system with the Trespass to Premises legislation that allows banning to take place without any sort of appeal process. The PCs set this law up and the NDP continue with the law. Why? It's the way the system handles advocates who will not be silenced like Ruth Adria of the Elder Advocates of Alberta society. We pay for all these offices that are powerless to help us.

Carol Gardiner There is also your ombudsman, and your mp's office. The wheels turn slowly but if enough of us continue the fight things will change. We all need to fight on the same fronts in order to take advantage of the power of numbers. Don't feel defeated be persistent. Stephen let us know who your mp and ombudsman are so that we can write letters on your behalf. If enough do so they will have to look into it.
Julie Ali Carol Gardiner The ombudsman was consulted for Shauna McHarg's case and he agreed she was unfairly treated and you know what? Nothing was done. Poor Shauna went to the court to get the information about why she was banned and the court said that Covenant Health did not have to give her the information. The whole system is cover your butt and set up by the Tories to protect the government's lack of oversight and penalties for this junk. The NDP are no better and have done nothing despite yapping to the PCs about this stuff for decades. Julie Ali The entire system is under the boots of the government of Alberta. Shauna McHarg's case of banning ended with her mother dying this year. It is an unjust society we live in and the GOA is simply not doing its job with reference to oversight of folks in the continuing care system.

Sharon Hobin That's why I took care of my mom at home 🏡 would not trust anyone else with her care make sure you get all the facts when putting her in a home . This will be one of the biggest decisions you will ever make .

Julie Ali And make sure you are present at the facility regular. It's important to get the medical notes when there are problems. And yes, it's important to stay calm and document everything. It's the only way to get results.

Julie Ali I would go to Friends of Medicare for help. Sandra Azocar is very effective. The folks at PIA (Public Interest Alberta) aren't productive now that the NDP are in power as they are mostly NDP supporters. They were useful when the PCs were in power.
Jan Rollins Contact an Attorney ASAP, they will not charge you until they win the case
Julie Ali Most lawyers will not help you. There will be no value placed on a person in a continuing care facility who is abused. Sometimes there is some money if the person dies but most of the time going to court is useless. The only reason to go to court is to defend yourself from retribution which is present in the system. Continuing care facilities send cease and desist letters and sue families to shut them up.

Tanya Ducharme There is an elder abuse hotline in Alberta. I got IMMEDIATE response when I called with respect to the care my mom was receiving and it wasn't anywhere as horrible as what you are going through. Call them asap and I believe it's available 24/7

Julie Ali If you are talking about the Protection for Persons in Care hotline, sure they take your information but what do they actually do? Not much. Its a whitewashing agency under the boots of Alberta Health.

Tanya Ducharme There were very helpful for me getting my mom proper care. They held an immediate meeting at the facility. Once they started the investigation they found a lot of problems and got to work in correcting them.

Visitation and Family Presence Directive Why has AHS implemented a Visitation and Family Presence Directive?
The Minister of Health asked AHS to develop a standardized policy and procedure to guide visitation and
family presence in all AHS owned or funded sites in Alberta. This policy is currently in development and is
expected to be effective March 31, 2017. The directive will provide temporary guidance for AHS owned or
funded continuing care facilities until the full policy is in effect.
I don’t understand. What factors could influence a decision to limit family presence and visitation?
Many factors are taken into consideration when determining limitations to family presence and visitation,
including the following:
 Wishes of the resident (or their alternate decision maker)
 Health needs of the resident as determined by the care team
 Privacy needs of the resident, or other residents
 Illness or contagious disease at the site
 Legal reasons (e.g. Court Order)
 Family/visitor behaviour concern
 Urgent need to protect the well-being, safety and security of any resident, staff, family or visitor
Our goal is always to use the least restrictive approach to the safety and well-being of residents and staff I disagree with limitations to my visitation. What can I do?

The site manager and patient relations have not been able to resolve my concerns. What is my next
course of action?
AHS created a Visitor Management Appeal Panel that may be available to hear concerns that have not
been resolved through site management or patient relations. The panel will include at least one non-AHS
member to represent patient/family perspectives and will work with parties involved to come to an agreeable
solution. You can initiate the panel process by contacting site management or connecting with Patient
Relations directly.
Who will make the final decision on visitation/family presence?
The Visitor Management Appeal Panel makes recommendations to the AHS Chief Zone Operating Officer
or if applicable, the Chief Executive Officer of the contracted service provider, who will make an informed
decision after careful review. You will still have the right of external appeal if you have not been able to
reach an agreement. *** Basically what all this means is that AHS has had some bad publicity about banning family from seeing loved ones in the continuing care system.Without consulting families who have been banned for the most part they have made decisions about the banning of folks and in my opinion there isn't much change from the situation from before. I mean before they got the directive from on high (from the Health Minister) they were sending folks to Patient relations which of course cannot do anything about the banning. Now they are simply adding a few more steps to the business which is an internal appeal process that again, isn't satisfactory. What I feel all the new steps do is simply tidy up loose ends. In the end, you remain banned. But it's done internally and no more media attention. Pretty neat. But in the end it does not solve the problem which is transparency, accountability and fairness. What is required is for there to be visitation rights for the residents as well as an independent appeal process in the Trespass to Premises law. This would require an amendment that the government is loath to do since this would mean public revelations of the bullying of the families and seniors like Ruth Adria who has been escorted out of facilities by security guards for no good reason other than folks are afraid of her work and courage. It's shameful. Just shameful. And we should all yap endlessly about this junk and vote out the NDP like we voted out the PCs for this retribution of innocent people.

ays the province has failed to respond to the continuing issue. She says family members concerned about their relatives care are being banned for simply asking questions and residents are being evicted for the same reason.She says this happens when someone speaks out against the facility about concerns.

“We are asking the NDP government to address this violation of rights,” remarks Adria.

Adria says the NDP has done nothing but ignore the issue since taking power.

“The minister is failing to meet with people, the MLAs are failing to meet with constituents to address this issue,” explains Adria. “This is a long-standing issue.”

Adria says the Trespassing on Premises act, which is the document cited when family is banned and residents are evicted, was already struck down by a provincial court judge…

“It permits banning any person without reason but you know, when you are in a facility visiting, and we’re visiting elderly people who we are a comfort for, and some big security guard or officer in a uniform appears, you’re not going to argue, you’re going to leave,” explains Adria.

Adria says the NDP is well aware of the issues.

“The government was aware of the issue long before they were elected,” claims Adria. “And they appeared sympathetic, even having press conferences, they appeared sympathetic.”

Adria says by not acting on this, the province is endorsing the banning, evections and threats. The group claims relevant FOIP records were shredded after the NDP came into power, rather than given to victims have been banned to prove their case. (twd)
